Nighing - Terms of Service

1. Acceptance of Terms

By accessing and using nighing ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

nighing is a productivity and note-taking platform. We provide tools for capturing ideas, tracking time, and analyzing productivity patterns using AI technologies.

3. No Refunds Policy

ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE.

By upgrading to a Pro subscription, you acknowledge and agree that nighing does not offer refunds for any partial subscription periods, unused services, or accidental purchases. You may cancel your subscription at any time to prevent future charges, but no pro-rated refunds will be issued for the current billing cycle.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NIGHING AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; and
  • Unauthorized access, use, or alteration of your transmissions or content.

In no event shall nighing's aggregate liability for all claims related to the service exceed the greater of one cent ($0.01) for the past six months of the service in question.

5. Use of AI Features

Our Service utilizes Artificial Intelligence (AI) providers (such as OpenAI, Google Gemini, and Groq) to generate summaries and insights. You acknowledge that AI output may not always be accurate, complete, or unbiased. You are responsible for verifying any AI-generated content before relying on it.

6. User Accounts

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
